Kite Games — Terms of Service

These Terms of Service (“Terms”) govern your use of the games and applications (each, a “Game” and together the “Games” or “Services”) published by Kite Games (“Kite Games”, “we”, “us”, “our”), a company based in Istanbul, Türkiye.

1. Eligibility

Our Games are intended for a general audience and are not directed to children under 13. By using a Game, you confirm that you are at least 13 years old (or the minimum age of digital consent in your country, if higher). If you are a minor in your jurisdiction, you may use the Games only with the involvement and consent of a parent or legal guardian.

2. License to use the Games

Subject to these Terms, Kite Games grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and play our Games on a device you own or control, for your own personal, non-commercial entertainment.

3. Restrictions

You agree that you will not:

• copy, modify, reverse-engineer, decompile, disassemble, or create derivative works from a Game, except to the extent this restriction is prohibited by applicable law;
• rent, lease, sell, sublicense, distribute, or otherwise commercially exploit a Game;
• use cheats, bots, automation, exploits, memory editors, or unauthorized third-party software to gain an advantage or interfere with normal gameplay;
• attempt to gain unauthorized access to our systems, servers, or the accounts or data of other players;
• remove, obscure, or alter any proprietary notices; or
• use the Games in any way that is unlawful, fraudulent, or harmful, or that violates the rights of others.

4. Virtual items and in-game content

Our Games may include virtual items, in-game currency, power-ups, levels, and other digital content (“Virtual Items”).

• Virtual Items are licensed, not sold, to you for use within the Games, and are part of the Services.
• Virtual Items have no monetary value, cannot be redeemed for real money or goods, and are not transferable outside the Games.
• You do not own Virtual Items. We may manage, regulate, modify, or remove Virtual Items at any time, with or without notice, and we have no liability to you for doing so.
• The current version of our Games does not offer in-app purchases. If we introduce paid content in the future, any purchases will be processed by the applicable app store (such as Apple) under its terms, and additional purchase terms will apply.

5. Leaderboards and user-provided content

Some Games let you choose a display name, avatar, or frame and appear on public leaderboards. You are solely responsible for the content you submit and agree not to use any display name or content that:

• contains personal information (your own or someone else’s, such as a real full name, email, or phone number);
• is offensive, obscene, hateful, harassing, defamatory, or otherwise objectionable; or
• infringes the rights of any third party or violates any law.

We may remove content, reset a display name, or restrict leaderboard access at our discretion if we believe this section has been violated.

6. Intellectual property

The Games, including all software, code, artwork, characters, audio, text, and design, and all related trademarks and logos, are owned by Kite Games or its licensors and are protected by intellectual property laws. Except for the limited license in Section 2, these Terms do not grant you any right, title, or interest in the Games or our intellectual property.

7. Third-party services

Our Games use third-party services, including Apple (app distribution), Google Firebase (analytics and crash reporting), and Unity Gaming Services (anonymous sign-in and leaderboards). Your use of the Games may be subject to those parties’ terms, and the data practices associated with them are described in our Privacy Policy. We are not responsible for third-party services we do not control.

8. Disclaimer of warranties

To the fullest extent permitted by law, the Games are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Games will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.

9. Limitation of liability

To the fullest extent permitted by law, Kite Games and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Games. To the extent liability cannot be excluded, our total aggregate liability for any claim relating to the Games is limited to the amount you paid us for the Game in the 12 months before the claim, or, if you paid nothing, to USD 50 (or the equivalent in your local currency).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including your mandatory statutory rights as a consumer.

10. Indemnification

You agree to indemnify and hold harmless Kite Games from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Games, or your violation of any law or the rights of a third party.

11. Termination

You may stop using the Games at any time by deleting them from your device. We may suspend or terminate your access to the Games at any time if you breach these Terms or if we discontinue a Game. Sections that by their nature should survive termination (including Sections 4, 6, 8, 9, 10, and 12) will continue to apply.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. The Istanbul Courts and Enforcement Offices (Istanbul Adliyesi Mahkemeleri ve İcra Daireleri) shall have jurisdiction over any dispute arising out of or relating to these Terms, without prejudice to any mandatory consumer-protection rights that entitle you to bring proceedings in your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, ask you to review and accept the updated Terms within the Game. Your continued use of the Games after the changes take effect means you accept the updated Terms.

14. Apple App Store — Additional Terms

These additional terms apply where you download a Game from the Apple App Store. You acknowledge and agree that:

1. These Terms are concluded between you and Kite Games only, and not with Apple. Apple is not responsible for the Games or their content.
2. Apple has no obligation to provide any maintenance or support for the Games.
3. If a Game fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the Game; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Games.
4. Apple is not responsible for addressing any claims by you or a third party relating to the Games, including product-liability claims, claims that a Game fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or privacy law.
5. In the event of any third-party claim that a Game or your use of it infringes that third party’s intellectual property rights, Kite Games (not Apple) is responsible for the investigation, defense, settlement, and discharge of such claim.
6. You represent that you are not located in a country subject to a U.S. Government embargo (or designated as “terrorist-supporting”) and that you are not on any U.S. Government restricted-parties list.
7. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
